Real Estate Conveyances
Deed Documentary Stamps: |
The rate of .70 cents per $100 of consideration or fraction thereof on deed or other instruments conveying an interest in Real Estate Documentary Stamps are computed on the total selling price, rounded up to the next even $100.00. A minimum of 70 cents Documentary Stamps must be affixed to deeds which have a consideration of $100 or less.
Example: $4,550 rounds up to $4,600 x .007 = $32.20 for Deed Doc Stamps “Consideration” is defined in 201.02(1), F.S., as “includes, but is not limited to, the money paid or agreed to be paid; the discharge of an obligation; and the amount of any mortgage, purchase money mortgage lien or other encumbrance, whether or not the underlying indebtedness is assumed. If the consideration paid or given in exchange for real property or any interest therein includes property other than money, it is presumed that the consideration is equal to the fair market value of the real property or interest therein.” Failure to pay the full amount of documentary stamps due will result in a penalty under 201.17(2)(b), F.S. The penalty is equal to 10 percent of any unpaid tax and may escalate to 50 percent of the unpaid tax, depending on the amount of the time the tax is unpaid. Interest of one percent per month is charged based upon the amount of tax due from the date of recordation until the tax is paid. |
Mortgage Documentary Stamps: |
Rate .35 cents per $100 of consideration or fraction thereof on promise to pay.
When a deed contains an assumption clause for a mortgage, documentary stamps are due at the rate of $0.35 per $100.00 or fraction thereof. The clause must contain the language “assumes and/or agrees to pay”. “Subject to” is not an assumption clause. If there is a separate assumption agreement being recorded with the deed, the Documentary Stamps are to be placed on the Assumption. This is in addition to the $0.70 per $100 as described above. Example: Amount of note $30,050 must be rounded up to $30,100. This amount multiplied by .0035 equals $105.35 for the payment of Documentary Stamps. |
Intangible Tax: |
A nonrecurring tax of 2 mills (2%) on the dollar of the just valuation of all notes, bonds, and other obligations for payment of money, which are secured by mortgage, deed of trust, or other lien upon Real Property situated in the State of Florida.
Mortgages or other instruments of indebtedness, secured by real estate, require the payment of “Class C” intangible tax. The nonrecurring tax is charged at the rate of 2 mills. It is imposed in each dollar of obligation. An easy rule to remember is intangible tax is $2 per $1,000. Example: Amount of note $30,050 x .002 = $60.10 (It is not necessary to round up to the nearest $100 for Intangible Tax.) |
