Public Records Available per Supreme Court Order
On June 17th the Flagler County Clerk of the Circuit Court & Comptroller will allow records viewing. The Public will now have the capability to view court records online including the following court types: County and Circuit Civil, County and Circuit Criminal & Probate. This unprecedented capability is due to Florida Supreme Court Order 15-18.
This office has been on the cutting edge of electronic initiatives since Clerk of Court Gail Wadsworth’s promise to allow people to do business with her office “on-line and not in-line”. In July 2014 her office was recognized for becoming virtually paper free with the advent of a paper on demand courts process. Wadsworth’s office offers their continued commitment to providing online viewing of all records in compliance with AOSC 15-18, while protecting constituency privacy and confidentiality.
Registered User Agreement
Additional documents may be viewed online by completing and submitting a Registration Agreement. Cases and documents made confidential by statute or court order are excluded. The Supreme Court Order requires that all Registration Agreements must be notarized. Please complete the Flagler County Registered User Agreement to request an user account. One User Agreement is required per individual attorneys.
Public Notice
Any person preparing or filing a court document should not include a social security number or a complete bank account, debit, charge, or credit card number in such document, unless required by law or court rule, or necessary to the adjudication of the case.
Any person has a right to request that the Clerk of the Circuit Court remove from an image or copy of a court document a social security number or complete bank account, debit, charge, or credit card number contained in a court document. Such request must be made in writing and delivered by mail, facsimile, electronic transmission, or in person to the Clerk of the Circuit Court. The request must specify the case number, the title of the document, and the identification page number of the document which contains the number to be redacted. A fee will not be charged for the redaction of a social security number or a complete bank account, debit, charge, or credit card number pursuant to such a request.
The Clerk has no authority to refuse to accept any document or pleading that contains the aforementioned sequential numbers. It is the responsibility of the filer to know whether the information is required by law or necessary to the adjudication of the case.
